The COVID-19 pandemic has spilled-over different health, social and economic effects worldwide reverberating deep changes in the daily routines of families, companies and governments. Taking for granted the emergency role of governments facing the COVID-19 pandemic context, the objective of this article is aimed to analyze the Brazilian case through a study of the Constitution Amendment Project 10/2020 and the consequent approval of the Constitution Amendment 106/2020, responsible for the creation of the “War Budget”. Based on the results presented in the research it has been demonstrated that the "War Budget" has clear biases and structural limitations that reflect the existing filed of power in the country despite being considered one of the main legal frameworks that emerged in the fight against the pandemic.
